Merry Hill QRious Quest – Terms and Conditions

1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of the Merry Hill QRious Quest Experience (“Service”), operated by Merry Hill Shopping Centre (“we”, “us”, “our”). By participating in the Service, you agree to be bound by these Terms.

2. Eligibility

  • The Service is open to all ages.
  • Participants under 16 years of age cannot provide marketing consent but may still participate in the experience.
  • You must provide accurate information when prompted.
  • One participation per person per QR code location.

3. How the Service Works

3.1 QR Code Scanning

  • Scan QR codes located throughout Merry Hill Shopping Centre using your mobile device.
  • Each scan opens a webpage in your browser.
  • You will be prompted to provide required information.
  • A session cookie will be stored to maintain your participation.

3.2 Data Collection

When participating, you will be asked to provide:

  • Email address.
  • Postcode.
  • Age range.
  • Marketing consent preferences (if aged 16 or over).

3.3 Experience Types

QR code scans may result in:

  • Points awarded (entries into grand prize draw).
  • Instant prizes (Daily Prize Drops).
  • Access to augmented reality games.

4. Data Protection and Privacy

4.1 Data Handling

  • Your personal data is processed and stored by approved third-party service providers.
  • Data is collected and processed in accordance with applicable data protection laws.
  • We will only use your data for the purposes stated in our Privacy Policy.

4.2 Marketing Consent

  • Marketing consent is only available to participants aged 16 and over.
  • You may withdraw marketing consent at any time by clicking unsubscribe on any emails from Merry Hill, or by contacting merryhill.reception@savillspm.co.uk.
  • Participants under 16 cannot provide marketing consent but may still participate in the experience.

4.3 Cookies

  • Session cookies are used to maintain your participation experience.
  • By continuing to use the Service, you consent to our use of cookies.

5. Points

5.1 Points System

  • Points are awarded for scanning participating QR codes.
  • Each point represents one entry into applicable prize draws.
  • Points have no cash value and cannot be transferred.

6. Grand Prize

  • Prize draw entries are accumulated throughout the promotion period.
  • Prize draw terms and dates will be communicated separately.
  • The grand prize draw is free to enter, no purchase is necessary and no financial or bank details will be requested.
  • Merry Hill reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions.
  • Merry Hill reserves the right to update these Terms and Conditions from time to time and any updated version will be effective as soon as it is published on the website or web-app.
  • The decision of Merry Hill regarding any aspect of the competition or prize draw is final and binding and no correspondence will be entered into about it.

6.1 Grand Prize Draw

  • The winner will be selected randomly from eligible entries.
  • Winners will be notified via the email address provided.
  • The prize is non-exchangeable, non-transferable and no cash alternative is offered.
  • Merry Hill reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond Merry Hill’s control make it necessary to do so.
  • The decision of Merry Hill regarding any aspect of the competition or prize draw is final and binding and no correspondence will be entered into about it.

6.2 Grand Prize Limitations of Liability

  • Insofar as is permitted by law, Merry Hill, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Merry Hill, its agents or distributors or that of their employees. Your statutory rights are not affected.
  • The winner consents to participate in promotional activity, should this be organised by the Merry Hill and possibly supported by the media, to directly promote the shopping centre and the competition.

6.3 Grand Prize Eligibility

  • Unless otherwise stated, our prize draws and competitions are open to all except employees of Merry Hill, centre retailers, their families, agents or any third party directly associated with the administration of the prize draw.
  • Entrants under 16 must get consent from their parent(s) or legal guardian(s) before entering. The parent(s) or legal guardian(s) of entrants under 16 agree to these Terms and Conditions on behalf of the entrant.
  • In entering, you confirm that you are eligible to do so and eligible to claim any prize you may win. Merry Hill may require you to provide proof that you are eligible to enter the competition or prize draw.

7. Daily Prize Drops

7.1 Prize Redemption

  • Daily prize drops are provided by individual retailers within Merry Hill Shopping Centre.
  • Some retailers may apply additional terms and conditions specific to their prize. Where applicable, these retailerspecific terms will be displayed at the point of redemption, including via email and/or on the digital redemption screen presented on the participant’s mobile device.
  • Each prize has specific redemption terms and conditions.
  • All prizes must be redeemed within the specified redemption timeframe. Failure to redeem a prize within this period will result in the prize being forfeited and no alternative or compensation will be offered.
  • Redemption terms vary by retailer and will be clearly communicated when prizes are awarded.
  • All daily prize drop wins are valid only for redemption at the specified retailer within the Merry Hill centre only.

7.2 Prize Expiry

  • All prizes have expiry dates which will be clearly stated when awarded.
  • Expired prizes cannot be redeemed or exchanged.
  • No extensions will be granted for expired prizes.

7.3 Prize Limitations

  • Prizes are subject to availability.
  • Unless otherwise stated, our prize draws and competitions are open to all except employees of Merry Hill, centre retailers, their families, agents or any third party directly associated with the administration of the prize draw.
  • If a player is ineligible for prize redemption for any of the reasons stated above, no alternative prize will be provided.
  • Prizes have no cash value and cannot be exchanged for cash.
  • Prizes are non-transferable and non-exchangeable unless otherwise stated.

8. QRious Quest In Centre Participation

8.1 General Behaviour

  • QRious Quest at Merry Hill is a free family event. Children must be over the age of 3 to take part, and any children under the age of 14 must be accompanied by an adult.
  • The QRious Quest experience is a QR trail & AR game experience. As the event is public, participants may meet other groups or individuals also playing the trail or games throughout the centre. Participants must be mindful and respectful of other guests sharing the space.
  • Disruptive, aggressive, or inappropriate behaviour will not be tolerated and may result in removal from the event.
  • Participants must be respectful to event staff throughout their experience. Staff will not tolerate rude, disruptive, or aggressive behaviour.

8.2 In Centre Health & Safety

  • Participants taking part in this activity do so at their own risk and Merry Hill / Kit & Caboodle cannot be held responsible for any accidents caused by in house structures, objects, materials, or by the actions of other participants.

8.3 Personal Belongings & Liability

  • Merry Hill / Kit & Caboodle  take no responsibility, nor are they liable for any damage or staining to personal items during the experience.

8.4 Photography & Media

  • Merry Hill and Kit & Caboodle Ltd make take photographs or video footage for promotional purposes. By participating, you consent to potentially being featured in such media. If you do not wish to be photographed, please inform a member of staff.

9. Augmented Reality Games

9.1 Games Access

  • Certain QR codes may launch augmented reality games.
  • Games are accessed through your mobile device’s web browser.
  • Additional device permissions may be required for camera access.

9.2 AR Game Participation

  • Follow all on-screen instructions when playing AR games.
  • Ensure you are in a safe environment when playing.
  • We are not responsible for any injuries or accidents that may occur during gameplay.

10. Technical Requirements

10.1 Service Availability

  • Compatible smartphone or mobile device with camera functionality.
  • Internet connection required.
  • Modern web browser capable of supporting the Service.

10.2 Service Availability

  • The Service is provided “as is” without warranty.
  • We do not guarantee uninterrupted service availability.
  • Technical issues may affect your ability to participate.

11. User Responsibilities

11.1 Conduct

  • Use the Service only for its intended purpose.
  • Provide accurate and truthful information.
  • Respect other shoppers and shopping centre property.
  • Follow all shopping centre rules and regulations.

11.2 Prohibited Activities

  • Attempting to manipulate or abuse the points system.
  • Sharing or transferring QR codes or prizes inappropriately.
  • Using automated systems to scan codes.
  • Any fraudulent or deceptive behaviour.

12. Limitations and Disclaimers

12.1 Service Limitations

  • We reserve the right to modify or discontinue the Service at any time.
  • Prize availability is subject to change without notice.
  • We are not responsible for technical failures or user device issues.

12.2 Liability Limitations

  • Our liability is limited to the maximum extent permitted by law.
  • We are not liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed the value of any prize awarded.

13. Retailer Responsibilities

13.1 Instant Prizes

  • Individual retailers are responsible for honouring their instant prize redemptions.
  • Disputes regarding instant prizes should be directed to the relevant retailer.
  • We are not liable for retailer failures to honour prize redemptions.

13.2 Prize Terms

  • Each retailer may have additional terms and conditions for their prizes.
  • Participants must comply with individual retailer terms when redeeming prizes.

14. Termination

14.1 Service Termination

  • We may terminate or suspend the Service at any time.
  • Upon termination, unredeemed prizes may expire.
  • Prize draw entries accumulated prior to termination will remain valid.

14.2 User Termination

  • You may stop participating at any time.
  • Previously earned points and prizes remain subject to these Terms.

15. Modifications

  • We reserve the right to modify these Terms at any time.
  • Changes will be effective immediately upon posting.
  • Continued participation constitutes acceptance of modified Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

By participating in the Merry Hill QRious Quest  Experience, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
